Workers’ Compensation Insurance, also known as worker’s comp, or WC, protects businesses from lawsuits related to workplace injuries or illnesses. It covers medical expenses, lost wages, rehabilitation costs, and a range of other damages which are likely to arise within your workplace. 

Employers are protected from liability for workplace injuries or illnesses suffered by their employee. Many employers are legally required to pay premiums into a fund to pay claims. 

If you are a business owner or currently have employees reporting to you, you should always have workers comp insurance because it provides protection against lawsuits filed by injured employees. This helps prevent costly legal fees and settlements.

For employees, WC covers medical costs, lost wages, disability payments, and death benefits. It has been put in place for employees who suffer injury or illness at work, so that they will get sick pay and access to medical care when necessary.

How To Get Workers’ Comp

Firstly, it is worth noting that you can only get workers’ comp if you have had an injury within your place of work. Your employer is also required to have workers’ comp in place, otherwise they can face additional legal complications.

What Is Covered?

While there are certain policies in place which have the bare minimum in terms of WC, some insurance companies will provide more of a complete package. For example, employees whose occupation or workplace poses more of a threat for serious injury or even death, it is necessary to provide extra compensation and have the funds in place. 

Employees will thank those who ensure that they have a better workers’ comp policy. This is so that they can focus on recovering and getting themselves fit for work again. 

Most workers’ comp has some kind of salary replacement, which can allow employees to still have some type of income when they are physically unable to work. There will also be survivor benefits and healthcare reimbursement. 

The main catch to workers’ comp, however, is that employees are giving up their right to sue their employers for negligence. This means that employers have a much lower risk of serious legal consequences in the long run. 

Types Of Workers’ Compensation

There are two main types of WC, which have slightly different requirements and benefits. 

Coverage A refers to salary replacement payments, medical care, rehabilitation including specialist treatment, and death benefits when necessary. This comes directly from the employers’ insurance, and is the norm across the country except for Texas. 

There is, however, some variation between the states which means that certain groups of workers are less likely to qualify for particular benefits. 

Coverage B is usually a result of a lawsuit filed by the employee following suspected negligence or misconduct in the workplace. This pays benefits that exceed the minimum amount of coverage A. 

While employees typically waive their rights to sue their employers when they are getting workers’ compensation, there are a few exceptions which have been made in the past under strictly defined circumstances. Because of this, most WC policies offer some combination of the two types of coverage. 

Summary

Each state has slightly different workers’ compensation requirements by law, which can also vary between different places of work. Those who engage in more physical work are more likely to become injured than those who work in an office, for example. 

As an employer, it is essential that you take out WC as soon as possible in order to continue to operate business within the law. Failure to do so can lead to serious consequences. It could be worth speaking with someone who is more experienced with workers’ comp if you want to find out more.
